Terms & Conditions
The present Terms and Conditions are applicable to the relationship between Noon Consulting BVBA (BE0511989457) - hereinafter WinWin Functional Fitness and our Clients. These terms govern all services, products, offers, orders, contracts, and invoices issued by WinWin Functional Fitness, unless otherwise agreed upon in writing.
By purchasing any product or service from WinWin Functional Fitness, you explicitly confirm that you have read and accepted these Terms and Conditions without reservation. Each time you place an order, please ensure you have read and understood the Terms and Conditions applicable at that time.
WinWin Functional Fitness offers all products and services available on our website, www.winwinfunctionalfitness.be.
Pricing Options:
* Refunds: Subscriptions and plans cannot be refunded if sessions are unattended. We do not offer refunds on services or products due to a change of mind or address (please refer to our suspension policy). You must be over 18 years old to purchase through our booking system.
* Membership Subscriptions: These provide access to a limited or unlimited number of sessions and involve monthly payments. Your membership activates on the date of purchase.
* Card Passes: These grant access to a limited number of sessions, ranging from 1 to 10 sessions, depending on the pass type.
* Open Gym Access: This grants access to one-hour sessions. All purchases are definitive.
* Personal Training:This is a tailored training program that can incorporate various methods, including Pilates and yoga.
Fee Increases:
Fee increases apply to new subscriptions or passes. For existing subscriptions, changes in fees will only apply upon their automatic renewal. Pricing plans may change over time.
Payment:
All prices are indicated in euros and include VAT.
Various payment methods are available through our app when placing an order (Visa, SEPA, Bancontact, etc.). If you prefer to pay offline, payment must be made before the class via QR Code or bank transfer.
Subscriptions require regular payments. In case of termination, a notice must be sent 30 days prior to the renewal date via email to manager@winwinfunctionalfitness.be.
In the event of non-payment or any other related issue, the owed amount will become due and payable by operation of law, incurring a yearly interest of 3% of the original amount.
Booking Policy:
Sessions must be booked in advance. A minimum of two persons is required per class. If only one person books a class, the session may be cancelled, and the client will have the right to reschedule. WinWin Functional Fitness will offer alternative options to clients affected by such cancellations.
If you cannot attend a session for which you booked a spot or were added to the waitlist, you must cancel the booking in due time to make the spot available to other clients.
Cancellations:
Cancellations must be made via our Website or Application a maximum of 8 hours before a session. Cancellations will not be accepted via phone or email.
Being on a waitlist signifies a commitment to joining that session. If your plans change or you can no longer attend, you must remove yourself from the waitlist in a timely manner.
Late Cancels and No Shows:
Credits will not be reimbursed or refunded for late cancels or no-shows. In the case of a late cancellation, you will receive a warning. Upon the third late cancellation, a €5 penalty fee will be automatically charged. For every no-show, clients will be charged a €5 penalty fee.
Gym Rules:
* Clients must be punctual for Group Sessions, as late arrivals negatively affect the rest of the group. WinWin Functional Fitness may request late arrivals to perform burpees.
* WinWin Functional Fitness is not responsible for any loss, damage, or theft of personal property within the gym.
* All items found within the gym will be kept for 30 days. After this period, WinWin Functional Fitness reserves the right to reuse or dispose of them.
Suspension Policy:
Clients have the option to suspend their membership or postpone their plan for a specified period. All suspension requests must include a start and end date. A membership suspension must be for a minimum of one month.
All clients, with the exception of those on the WinWin Discover Plan, may suspend their membership without a suspension fee under the following conditions:
* The suspension must be taken in one continuous period.
* A maximum of one suspension is permitted per year.
* Business or holiday trips do not qualify as conditions for suspension or postponement.
Medical suspensions will be treated differently. These can be requested for longer durations with an official doctor's note.
To request a suspension, please send an email to manager@winwinfunctionalfitness.be before your desired suspension start date.
Obligations:
In the event that a client does not comply with their obligations, WinWin Functional Fitness reserves the right to cancel the agreement.
